A will generally directs probate property at death, nominates an executor, and can nominate guardians for minor children.

Checklist workspace

A will does not normally control property that passes by survivorship, beneficiary designation, trust ownership, or another contract-based transfer.

Confirm the final will reflects the testator's instructions and contains no blanks, missing pages, or draft markings. Verify identity, capacity, voluntary action, language access, and freedom from pressure in an appropriate setting. Confirm the governing state's witness, presence, signature, attestation, notary, and electronic-execution rules. Screen witness eligibility and conflicts before the ceremony rather than trying to repair them later. Use the lawyer's signing sequence and keep all participants together or connected only as the law permits. Complete any self-proving affidavit separately and correctly; do not assume notarization alone makes a will valid. Record the date, place, participants, page count, and disposition of drafts without adding unauthorized notes to the will. Store the original securely, give retrieval instructions to the appropriate fiduciary, and control superseded originals.
