Real property planning depends on the recorded deed, vesting language, liens, marital rights, and the law where the parcel is located.

A will or trust description should be reconciled with the recorder's actual ownership record and legal description.

Obtain the current recorded deed and legal description from the responsible land-record office. Identify every owner, ownership share, marital interest, survivorship term, trust, entity, or life estate. Collect mortgage, lien, tax, assessment, insurance, lease, easement, and association records. Compare the recorded title with the will, trust, transfer-on-death instrument, business agreement, and family plan. Confirm property location, owner domicile, homestead status, community-property issues, and cross-state consequences. Ask title and tax professionals about recording, transfer tax, reassessment, basis, creditor, and loan effects. Use the exact legal name and description accepted by the recorder; do not rely on a tax mailing summary. Retain the recorded instrument, receipt, title confirmation, and updated insurance and tax records.
